This summary is here to help. The full terms below are what apply.
1. About these terms
SAM AI is a brand operated by Jahaca FF Pty Ltd (ACN 686 173 320), a company registered in Victoria, Australia, with its registered office at Unit 15, 2-10 Hallam South Road, Hallam, Victoria, Australia, 3803.
In this document, “SAM AI”, “we”, “us” and “our” mean Jahaca FF Pty Ltd. Contact: [email protected].
These terms apply when you use our website at sme.ec, our free quiz, our courses, our AI chat, our membership, and the hosted business-system site we build for each paying member (together, the Service). By using the Service or becoming a member, you agree to these terms and our Privacy Policy at sme.ec/privacy. If you don’t agree, please don’t use the Service.
If you use the Service for a business, you confirm you are allowed to accept these terms for that business.
2. Who can use SAM AI
You must be at least 18 years old. The Service is designed for business owners and their teams.
3. What SAM AI is
SAM AI is an AI business assistant and membership. It includes courses and lessons, an AI chat (SAM), and for paying members, your own hosted business-system site on its own web address (a sub-domain), set up automatically when you join. We keep improving the Service, so features may be added, changed or removed over time. If we remove something important you are paying for, we will tell you first.
4. Your account
- Give us accurate details and keep them up to date.
- Keep your login private. You are responsible for what happens in your account, including what your team members do.
- Tell us straight away at [email protected] if you think someone has accessed your account without permission.
5. Membership, billing and cancelling
Price and trial
Membership costs US$19 for the first 14 days. After 14 days it automatically continues at US$97 per month, charged on the same day each month, until you cancel. Prices are in US dollars. The amount you will pay is shown at checkout before you confirm.
Payment
Payments are processed by Stripe. By joining, you authorise us (through Stripe) to charge your payment method at the start of membership and each month after. If a payment fails, we may retry it, and we may pause your access until it is paid.
Cancelling
- You can cancel any time by emailing us at [email protected], or through any cancel or billing link provided to you.
- If you cancel within the first 14 days, you won’t be charged the US$97 monthly fee.
- If you cancel after that, your membership stays active until the end of the month you have paid for, then stops. You won’t be charged again.
Refunds
We don’t give refunds for part-months or unused time, except where the Australian Consumer Law or another law gives you a right to one. If you cancel before the end of your first 14 days, you are never charged the US$97 monthly fee.
Price changes
We may change the membership price. We will give you at least 30 days’ notice by email before a new price applies to you, so you can cancel first if you choose.
6. Your member site and your data
- You own your data. Everything you or your team put into your member site, and the content you create in the Service, stays yours.
- You give us permission to store, copy, process and display your data only as needed to run the Service for you (including sending it to our service providers, as explained in our Privacy Policy).
- Export: you can ask for a copy of your data at any time by emailing [email protected].
- After you cancel: we keep your member site for 30 days so you can export your data. After that we delete it, and backup copies are removed within a further 30 days.
- We keep regular backups, but we recommend you keep your own copies of anything important.
- If you store other people’s personal information in your member site (such as your customers), you are responsible for having the right to do so and for following the privacy laws that apply to you.
Your business’s SAM memory is part of your data. You decide who in your business can see it, through your departments, and you look after any request from your staff or customers about their personal information in it.
If your business chooses to help SAM get smarter (the owner’s own choice, off until the owner taps “Yes”, and changeable at any time in Settings), you give us permission to create general learnings from how SAM is used in your business: common questions and challenges, with nothing that identifies you, your people or your customers. Each one is checked automatically twice before we use it, and anything the checks are not sure about is dropped without anyone reading it. We use these learnings to improve SAM for every member. They don’t identify you and they aren’t your data.
7. AI answers: helpful drafts, not final advice
SAM uses artificial intelligence from third-party providers. AI can be wrong, incomplete or out of date, even when it sounds confident. So:
- Treat SAM’s answers, documents and suggestions as drafts for a person to check.
- SAM does not give professional legal, financial, tax, accounting, engineering, medical or safety advice. For those, speak to a qualified professional.
- You are responsible for what you choose to do with SAM’s output, including anything you publish, send to customers or rely on for decisions.
- Other people may get similar answers to yours, and AI output may not be protected by copyright.
8. Fair use: what you must not do
You must not use the Service to:
- break any law, or help anyone else break one;
- send spam, or messages people haven’t agreed to receive;
- upload anything that is unlawful, harmful, defamatory, or that you don’t have the right to use;
- infringe anyone’s intellectual property or privacy;
- try to hack, overload, reverse-engineer or get around the security or limits of the Service;
- access other members’ accounts or data;
- use SAM to build a competing product, or scrape or copy the Service or its content in bulk;
- resell or share your membership or course access with people outside your business, unless we agree in writing.
9. Connected services (Google, YouTube and others)
You can connect other services to SAM, such as YouTube, Google Drive, Google Ads and Google Search Console. When you do:
- those services’ own terms also apply to you. By connecting YouTube, you agree to the YouTube Terms of Service;
- SAM only does the jobs you connected it for, as explained in our Privacy Policy;
- you can disconnect at any time from your Google Account permissions page (https://myaccount.google.com/permissions), or by asking us at [email protected];
- we are not responsible for those services, their availability, or changes they make.
10. Courses and our content
Our website, software, courses, lessons, videos, templates and the SAM AI name and brand belong to us or the people who license them to us. While you are a member, you may use course material for yourself and your own business. You must not copy, share, resell or publish it, or use it to train other AI systems, without our written permission.
11. Your content and feedback
You keep ownership of what you upload or create. You confirm you have the right to use it. If you send us ideas or feedback, we may use them to improve the Service without owing you anything.
12. Availability
We work hard to keep the Service running, but we can’t promise it will always be available or error-free. We may need to pause it for maintenance, updates or reasons outside our control.
13. Your rights under the Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Where the law allows us to limit our liability for a failure to meet a consumer guarantee (for example, where the services are not of a kind ordinarily acquired for personal, domestic or household use), our liability is limited, at our choice, to supplying the services again or paying the cost of having them supplied again.
14. Limits on our liability
Subject to section 13, and to the extent the law allows:
- we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data, goodwill or business opportunity;
- we are not liable for loss caused by relying on AI output without checking it, by connected third-party services, or by things outside our reasonable control;
- our total liability to you for all claims is limited to the fees you paid us in the 12 months before the event that caused the claim.
15. Your responsibility to us
If you use the Service for a business, you agree to cover us for losses caused by your breach of these terms, your unlawful use of the Service, or content you upload that infringes someone else’s rights, except to the extent we caused or contributed to the loss.
16. Suspending or ending access
We may suspend or close your account if you seriously or repeatedly break these terms, don’t pay, or use the Service in a way that could harm others or the Service. Where reasonable, we will warn you first and give you a chance to fix it. If we close your account without you being at fault, we will refund any unused prepaid amount. Section 6 (export of your data) still applies.
17. Changes to these terms
We may update these terms. We will post the new version on this page with a new “Last updated” date. If a change significantly affects members, we will email you at least 30 days before it takes effect. If you don’t agree, you can cancel before then.
18. Governing law
These terms are governed by the laws of Victoria, Australia. You and we agree to the jurisdiction of its courts. If you are a consumer living elsewhere, you also keep any rights the law of your own country gives you.
19. General
- If any part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we haven’t given it up.
- We may transfer these terms to a new owner of the business. You may not transfer them without our agreement.
- These terms and our Privacy Policy are the whole agreement between us about the Service.
